PenManifest Policies and Guidelines

The aim of PenManifest is to showcase and process the sale of original artworks and handcrafted articles in consignment with independent creators.

To ensure a venue that is safe and mutually respectful for all of our Curators, Consignors, Artists and Customers, PenManifest will defer to the following policies while conducting business.

These policies may be subject to change without notice.

Area of Operation

Primary point of sale will be through the online portal penmanifest.com. Product may be shipped worldwide as ordered, additional shipping costs incurred for international shipping shall be borne by the buyer.

The physical location for PenManifest is in Lethbridge, Alberta. PenManifest will perform the pickup of consignor inventory at no charge within reasonable range of the City of Lethbridge and Southern Alberta Region. Vendors outside of this area may be subject to additional procurement fees if product must be transported by PenManifest.

PenManifest will not accept vendor goods from outside of Canada for resale.

Product Limitations and Guidelines

Target Vendors and products must meet the following criteria to be eligible to be consigned to PenManifest:

-Artworks and crafted creations must be authentic and produced by the consignor

-All materials and rights must be owned exclusively by the consignor.

Limited Products

PenManifest reserves the right to refuse acceptance of any material under the following guidelines. The decision on whether not an item is rejected is solely in the power of PenManifest. Any property in the control of PenManifest that is rejected will be returned to the owner.

-Any material that is deemed offensive, racist, hateful or, in the opinion of PenManifest, infringes upon the dignity and rights of others

-Cultural resources that require government disposition for public sale (unless legitimate disposition documentation has been included with the product)

-Pornographic or sexually explicit materials (PenManifest recognizes the distinction between pornography and nudity in art. The determination of what material is considered to be art versus pornography will be in the made by a PenManifest representative)

Prohibited Products

PenManifest will not handle or trade in any of the following:

-Any material that is not owned by the vendor exclusively, including but not limited to any trademarked material for which the vendor does not hold an exclusive copyright

-AI generated art; we recognize AI as a useful tool and fun way to generate interesting images, however, we feel as though AI generated art depreciates the value of artists work and skills

-Cosmetics such as make up, perfumes, soaps or body washes

-Consumable items including but not limited to: baked goods, canned foods, preservatives or processed game

-Controlled substances (drugs, alcohol, tobacco, cannabis or pharmaceuticals)

-Firearms, ammunition and explosives

-Dangerous goods as outlined by the department of transportation

-Any material of pornographic or sexually explicit/suggestive nature involving a person under the age of majority

-Stolen goods or property acquired through fraudulent means

Storage of Products

All items consigned to PenManifest will remain in the possession of PenManifest for the duration of the Consignment Agreement. This ensures that product is available for immediate shipment upon sale to the buyer. Ownership of the product remains with the consignor during this time.

Risks and Liabilities

PenManifest does not carry a legal obligation for any losses due to theft, fire, flood, act of god etc for any products under consignment.

Privacy Protection

PenManifest abides by the Personal Information Protection Act in Alberta and a link to this document can be found in the forms section of penmanifest.com

PenManifest will not share any personal information to any outside or third party without explicit consent from the parties involved.

Transparency

PenManifest shall provide to a consignor upon request and within 30 days: proof of sale, invoice and shipping records of any product owned by the consignor and sold through PenManifest.

Contract of Consigned Goods

All consigned products through PenManifest shall be governed by the Consignment Agreement. A copy of the agreement can be found in the forms section of penmanifest.com.

Right to Refuse Service

PenManifest reserves the right to refuse or discontinue service to any persons without notice.
